Im really surprised no one has posted about his being suspended,in the locked thread,several poeple told me i was wrong about Kurts mental state,now a judge has found he not only smacked her head against a wall,but that the court believes he Has mental issues,hes been ordered to stay away from her,NO contact at all,plus he needs to do a court ordered mental health eval,and NASCAR has suspended him,now i know you all know this all,but i want to state now that hes done in cup,and maybe NASCAR alltogether.chevy has also suspended there relationship with Kurt.
 
The issue of a restraining order in a domestic violence case is very common. Restraining orders are also commonly issued as part of divorce proceedings, so don't read too much into a restraining order.

As for his suspension from NASCAR activities, I think this quote from the article is interesting.

Busch has not been charged criminally. The Delaware Attorney General's Office, which has had the case since early December, has not decided whether or not Busch will be charged.

So without a conviction and even without a charge being filed, just an accusation, Kurt Bush has been found guilty until proven otherwise in the court of NASCAR. It's all a show and this gets the fans attention and they will tune in to see what happens next.

Plus civil courts also have a lower standard of proof of guilt.

And that is the thing that irritates me.
 
first ,Panther..i didnt mean you thought what said was BS...i asked if you thought it WAS BS...theres a differance..lol...

and whether it be a "low court judge " or not...a judge and his or her ruling is still big,when and if this does go to court,they can use the ruling against him...and it being a lower court, doesnt make the decition that he need mental health any less important,you notice in todays news,that he is appealing NASCARs ruling,,but NOT the court ruling,im not sure he even could?..( yes THATs a question,,NOT a comment)and it wont change the ruling that the judge felt his testimony was rehearsed and "made up" (not the courts term,but as yall know,im not very smart and im usually wrong it seems)its also not going to change the fact the judge ruled against him and laid down a court ordered "stay away" order...


and did nascar jump the gun?..no, its their policy that on ANY courts ruling,they have to act,and thats also why they give an appeal option. its protocol..


and lastly...i still do and will always believe that his career is done,any corporate entity of any caliber (maybe that will be his "in" for the future)will or should go back as far as when he said,over his radio...he was going to kill jimmy spencer by putting him into the wall..and then his unnecessary outburst on trackside when spencer did a walk on to try and settle it with humor..spencer said later ,he did it to talk to kurt in a public place and to use humor to settle it nicely...kurt was the one who let loose a barrage of bad words (my ignorance just showed again huh?)and made a scene which many many people laughed at him for..they will look at all the things and temper tantrums hes thrown......just remember one thing...i do indeed HAVE the right to MY opinion...and im NOT in anyway trying to tell any of you ,you are wrong in your opinions...if this turns into a "dave's an idiot" thread again..ill close it,like i did before,,,,,,even if its not my section....

Imnot lawyer,but once he has had a court order telling him to have no conact with the girl nor anyone in her family,he has to comply,and besides why in hell would sane person appeal that,it would only hurt him in the legal court case,invoolving the act of violence itself,thats if they do charge him at all.

If he appeals the stay away order,and lose's ,that sets him up for a,,,,"hey look at this screwball appealing stay away order"
 
You really believe he is innocent,right? So lets do this,you keep your opinion,and i'll keep mine,and when its all over,we'll see who was right,but for now..you say hes innocent,and i'll say hes nut job who needs help in alot area's.
